<div dir="auto" style="font-family: inherit;">最高行政法院近日判決結果出爐，針對租約到期後，公所不續租、停止市場使用、封閉市場對外聯絡出入口及要求市場攤商期限內前搬遷等作為，認定均合法。另外，也認定義竹原零售市場產權為公所所有，並認為該建物結構因安全問題未續租，無補償之必要。</div>
<div dir="auto" style="font-family: inherit;">判決內文除重申經專業鑑定報告，認為評估建物耐震能力不足，有公共安全疑慮，義竹公所據此不予續租、封閉及要求搬遷等，均為合法的行為，也認定產權歸屬公所，無補償的必要。</div>
<div dir="auto" style="font-family: inherit;">黃阿家鄉長也再次強調，基於市場建築安全及長期商業機能不佳等問題，才不再續租，現在最高行政法院也已經認定公所合法，後續將依法辦理。</div>
